Besides the Berrien County Sheriff's Office, which patrols countywide, the Niles Police Department and the Benton Harbor Department of Public Safety make arrests and may maintain the resulting records for the two largest cities in the county. 

Under the Michigan Freedom of Information Act (FOIA), records of a public body, including arrest records, are viewed as public records because they are generated in the performance of official duties. 

Criminal history records are similar to arrest records but operate under a separate statutory framework, specifically the Bureau of Criminal Identification and Records Act. Where an arrest record captures the facts of a single criminal incident, a formal criminal history record is a dossier of an individual's criminal justice history, including arrests, convictions, incarcerations, paroles, and probations. 

Are Arrest Records Public Information in Berrien, Michigan?

Yes. Mich. Comp. Laws § 15.233 and other portions of the Michigan Freedom of Information Act stipulate that all persons, apart from incarcerated individuals, have the right to inspect or receive information related to the official acts of public officials, including law enforcement agencies. This right applies in the majority of cases, except when disclosure clashes with privacy rights or when a court orders a record sealed. 

Thus, anyone, anywhere, may submit a standard written request to an arrest record custodian and obtain a certified copy of the document sought. However, a valid request must include a complete name, mailing address, and contact information (such as an email or phone number). Requests can be submitted through official channels provided by the specific custodian, such as email, fax, mail, or an online form. 

What Do Public Berrien County Arrest Records Contain?

Michigan law requires law enforcement agencies to record certain details when booking an individual. These details provide a factual outline of the arrest and are usually shareable with anyone who requests a review. 

  • Information that identifies the arrestee: full name, aliases, age, weight, height, race, and sex 
  • Booking information: booking number or case number, mugshot 
  • Arrest date, time, and location

The public may use the Internet Criminal History Access Tool (ICHAT) to determine an individual's criminal history file maintained by the Michigan State Police. This record comprises felonies and misdemeanors reported by all Michigan Counties, including Berrien County. Users are typically required to pay a nominal fee for each search and must provide the subject's full name, date of birth, race, and gender. 

Anyone can utilize the FBI's Identity History Summary Checks to request copies of their own national criminal record. The agency charges $18 to send a certified copy of the record electronically or by mail.

Active Warrant Search in Berrien County

Law enforcement in Berrien County may apply for a warrant to effect an arrest under certain conditions. An arrest warrant is a signed order by a judge or magistrate authorizing local police to take the named individual into custody.

According to Mich. Comp. Laws § 764.1, a warrant is issued only when the applicant presents a proper complaint establishing reasonable cause that the person to be arrested has committed a felony, misdemeanor, or ordinance violation. Hence, a valid warrant must contain the name or physical description of the accused, the offense for which they are charged, and the signatures of the applicant and the issuing judge or magistrate. 

The Berrien County Sheriff's Office applies for and executes warrants as part of its public safety mandate. However, it does not publish a list of outstanding warrants on its website.

Once a warrant has been executed, it is considered public information under the state's FOI Act. However, Mich. Comp. Laws § 15.243(1)(b) grants law enforcement the discretion to keep an active warrant private to avoid alerting a suspect prematurely.

How to Find Arrest Records for Free in Berrien County

Record seekers can avail themselves of several county-level resources to locate Berrien County arrest records for free. 

  • Berrien County Sheriff's Office Inmate Search: The Sheriff's Office provides quick and comprehensive inmate locator options on its official website. The public can use these to browse recent bookings or locate specific individuals currently in county custody. 
  • Local FOIA Requests: While Niles, Benton Harbor, and other municipal departments do not host free online arrest databases, the public can obtain incident reports through a FOIA request, although some agencies may charge a nominal fee for record duplication. 

Inquirers can utilize the online tools from anywhere and do not need to submit a government-issued ID to review a record. However, these free resources generally exclude information on bonded-out individuals or those released beyond a certain time limit. Moreover, official arrest databases are often heavily redacted. 

Berrien County Arrest Report

A Berrien County arrest report is a detailed narrative written by an arresting or investigating officer that describes the facts of a criminal incident that resulted in an arrest. Compared to a standard arrest record, it goes into more depth in setting out the circumstances of the incident, including the possible motivations of the suspect. 

While the state's FOIA presumes arrest records are public, it treats arrest reports with greater caution due to the sensitive contents and the possible consequences of untimely public disclosure. Mich. Comp. Laws § 15.243(1)(b) allows local police to keep detailed arrest reports private for as long as there is a cogent reason for non-disclosure. 

How to Get an Arrest Record Expunged in Berrien County

Berrien County residents may get their arrest records automatically expunged or set aside under Michigan's Clean Slate laws, codified at Mich. Comp. Laws § 780.621 et seq

Under this framework, records of misdemeanor offenses are automatically shielded from public view for 7 years after sentencing. Each individual may have up to four misdemeanor convictions cleared this way during their lifetime. This limitation applies only to misdemeanor offenses punishable by 93 days or more in jail. For felony records, up to two eligible felonies are automatically shielded 10 years after sentencing or release from custody, whichever comes first. 

Individuals can also apply for manual expungement for eligible records that do not qualify for automatic shielding, or if shielding is needed before the automatic system comes into play. The process has several stages:

  1. Verify the eligibility of the specific conviction. 
  2. Verify that the waiting period has elapsed. The standard time limit before manual application is 5 years for a standard felony, 7 years for multiple felonies, and 3 years for a minor misdemeanor, according to Mich. Comp. Laws § 780.621d(1)-(3)
  3. Obtain a Certified Record of Conviction from the Berrien County Trial Court (Mich. Comp. Laws § 780.621d(7)(b)).
  4. Obtain an applicant fingerprint or criminal history report as proof of a clean post-release record. 
  5. Complete and file the "Application to Set Aside Conviction" form with the court and submit a copy, along with a $50 processing fee, to the Department of State Police for review. 
  6. Attend the court hearing to set aside the conviction. 

Note that arrest records expunged this way are not destroyed; rather, they are rendered "nonpublic." They will no longer appear during a standard online or physical search. However, they remain accessible to the judiciary and eligible government agencies. 

For criminal cases dismissed before or after trial, or where the verdict entered is "not guilty," the arrest records, biometric data, and fingerprints are automatically expunged or destroyed pursuant to Mich. Comp. Laws § 28.243(8).

How Do You Remove Berrien County Arrest Records From the Internet?

There is no law in Michigan that compels a third-party platform to remove arrest data it published online. However, individuals may contact the website administrator directly to request voluntary removal. 

Berrien County residents whose arrest records have been destroyed or whose convictions have been legally set aside can obtain a certified copy of the expungement order and submit it to the third-party website.
